Is anyone familiar with the laws pertaining to someone logging in without permission and downloading footage to use against me?
Long story short,
There was a fight inside of my home. The guest hurt my wife’s hand trying to get something from her. My wife then slaps the guest. The guest was an off duty police officer for a neighboring town. She had the password because several months ago there was a neighborhood burglary so I gave her the login to look at the outside cameras. I changed the password a few weeks later and wrote te new password down then placed it on my bookshelf for my wife to have it.
Months go by and the fight happens. She immediately logs in and screen records only the part where she was slapped.
A month later, she uses that video in a police report and gets my wife arrested. The video has been overwritten so the entire event is gone. Are there laws against her screen recording my footage without my permission?
That would depend on your local and state laws, wherever you may be. But with you at one point providing access to the cameras, it may be more of a civil issue in regards to the camera access. Talking generally without knowing really any details.
I would for sure change any passwords of accounts this other person has access to ASAP if you haven’t done so already. If you have any events that might be of significance down the road I would make sure to make copies of them and put them in a safe storage location for reference later if need be, especially if there was a fight or something of a similar nature that had occurred.
That’s a question for a lawyer in your area - not an Internet forum. However, I would agree with Tony that since you provided the credentials (and then did not change the PW after the legitimate use) you have little to stand on.
Your second mistake was not saving the entire event at the time.
